Suraj Jaiswal Faces Unlawful Threats and Eviction Despite Court Order

A shocking case of intimidation, illegal eviction attempts, and blatant disregard for the law has surfaced in Howrah, where Mr. Suraj Jaiswal, a legitimate property owner, is facing severe threats to his life and property. Despite securing an ad-interim injunction from the Learned 4th Civil Judge Jr. Division, Howrah, restraining the accused party, Mr. Jaiswal and his family continue to be forcefully threatened and harassed by goons, allegedly with the support of the local police.

According to Mr. Jaiswal, he is the rightful owner of Flat No. 102, located at 4, Ram Kumar Ghosh Lane, Salkia, Howrah-711106, measuring 1334 sq. ft., which remains in his possession. Earlier, he had executed a General Power of Attorney (GPA) in favor of Mr. Manmendar Sharma for supervision purposes. However, upon discovering Mr. Sharma’s misconduct, the said GPA was legally revoked on February 18, 2025, with due intimation via a registered notice and a public newspaper announcement.

The alarming sequence of events began on March 12, 2025, at approximately 4:30 PM, when the accused party, including Nirbhay Rai, Abhey Rai, and their hired goons, forcefully arrived at Mr. Jaiswal’s flat, armed with iron rods and other dangerous objects. They attempted to break into the flat and unlawfully seize possession. A loud and heated argument ensued, prompting Mr. Jaiswal to immediately contact the local police station. Upon arrival, the police officers verified the documents in the presence of the accused and confirmed that Mr. Jaiswal’s ownership was legitimate. The officers then instructed both parties to visit the police station for further proceedings.

However, despite Mr. Jaiswal’s visit to the police station the next day to formally lodge a complaint, the authorities refused to entertain his request and ignored his plea for five to six consecutive days. Following relentless efforts, on March 17, 2025, the police registered only a General Diary (G.D.E No. 1443) instead of an FIR against the accused parties, failing to take any concrete action.

As the threats escalated, Mr. Jaiswal’s wife approached the Deputy Commissioner of Police (DCP) office to inform the senior officials about the dire situation. The respected official assured the family that serious action would be taken regarding their complaint. However, contrary to these assurances, on March 27, 2025, the accused party, along with police officers, once again arrived at Mr. Jaiswal’s flat. They attempted to intimidate him into vacating the premises forcefully, even demanding that he hand over the keys under direct threats and taunts.

Matters took an even more disturbing turn on March 29, 2025, at around 7:13 PM, when Mr. Jaiswal and his wife visited the local police station seeking protection. Instead of receiving fair treatment, they were compelled to submit their mobile phones outside before meeting the Inspector-in-Charge (I.C.). Shockingly, rather than addressing their complaint, the I.C. threatened Mr. Jaiswal in various ways, openly supporting the accused in their efforts to take over the flat.

According to Mr. Jaiswal, the I.C. went to the extent of warning that he would deploy 20 women officers to counter the few female members in his family and forcefully evict them from their own home. Such blatant intimidation and abuse of power have left the family in a state of constant fear and insecurity.

“This is a clear case of injustice where the local police, instead of upholding the law, are allegedly siding with unlawful elements. My family and I are living in constant fear while the rightful court order is being ignored,” said Mr. Jaiswal in his urgent appeal to the public and higher authorities.

The matter remains sub judice before the Learned Civil Court, and any attempts by Mr. Sharma or his associates to take possession of the flat are illegal. Mr. Jaiswal is calling upon concerned citizens, human rights organizations, and legal bodies to intervene and ensure justice is upheld. Immediate and strict action must be taken against those violating legal protections and threatening an innocent citizen’s right to property and safety.
